WARRANTY ON TRAILER MOUNTED ELECTRIC BRAKE CONTROL & KEY FOB
WHO MAY USE THIS WARRANTY?
Kyle Group LLC d/b/a Autowbrake (“The Company”) extends this warranty only to the purchaser who originally purchased the product(s). It does not extend to any subsequent owner or other transferee of the product. Proof of purchase (original sales receipt) must accompany all warranty claims. This warranty is non-transferrable.
WHAT DOES THIS WARRANTY COVER?
This warranty covers defects in materials and workmanship of the Trailer Mounted Electric Brake Control and/or the Key Fob for the warranty period as defined below.
WHAT IS THE PERIOD OF COVERAGE?
The warranty for the Mounted Electric Brake Control starts on the date of the purchaser’s purchase and lasts for three (3) years. The warranty for the Key Fob starts on the date of the purchaser’s purchase and lasts for one (1) year. The warranty period for either product is not extended if The Company repairs or replaces the product.
The Company may change the availability of this warranty at its discretion, but any changes will not be retroactive. The Company reserves the right to change and improve the design of the product(s) without obligation to modify any product(s) previously manufactured.
WHAT ARE YOUR REMEDIES UNDER THIS WARRANTY?
The exclusive remedy under this warranty shall be the repair or replacement of the defective component at the Company’s option. The Company reserves the right to require that all applicable failed materials are available and/or returned to The Company for review and evaluation. With respect to any defective product during the warranty period, The Company will, in its sole discretion, either: repair or replace such product (or the defective part) free of charge or (b) refund the purchase price of such product. The purchaser is responsible for all costs and risk of loss associated with the delivery and return of the repaired or replaced product. The purchaser is also responsible for the cost of removal, the cost of forwarding the product, the cost of return, the cost of reinstallation, labor charges and damages incurred during installation or repair and replacement.
WHAT DOES THIS WARRANTY NOT COVER?
This warranty does not cover any damage due to: transportation; misuse; abuse; neglect; negligence, accident, improper testing; abnormal environmental conditions; improper installation; storage; failure to follow the product instructions or to perform any preventive maintenance; modifications; unauthorized repair; and normal wear and tear. This warranty does not apply to cosmetic damage, including but not limited to scratches and dents. Further, this warranty does not apply to any product that has been used with any third-party products, hardware or product that has not been previously approved in writing by The Company. This warranty does not extend to any product or parts which have been lost or discarded by the purchaser or to units, which have been altered or modified without authorization. This warranty also does not apply to any product, which is applied to a vehicle or trailer which is not rated for towing. Warning, this product should not be used with vehicles not rated for towing.
HOW DO YOU OBTAIN WARRANTY SERVICE?
To obtain warranty service, the purchaser should promptly call 1-319-521-2310 or make direct contact with the nearest Autowbrake service location during the warranty period. The purchaser should make the product available for inspection and evaluation.
LIMITATION OF LIABILITY
IN CONNECTION WITH THIS WARRANTY, THE COMPANY EXCLUDES ALL LIABILITY, WHETHER BASED ON CONTRACT (EXPRESS OR IMPLIED), TORT, OR PRODUCT LIABILITY, FOR ANY DAMAGES OTHER THAN THE LIABILITY ASSOCIATED WITH THE REPAIR OF ANY DEFECTIVE ITEM AS SET FORTH IN THIS WARRANTY. THE COMPANY ALSO SHALL NOT BE LIABLE FOR ANY PUNITIVE, SPECIAL, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, OR FOR LOSS OF REVENUE, PROFITS, LOSS OF BUSINESS, LOSS OF USE OF THE PRODUCT, ATTORNEY FEES, OR OTHER FINANCIAL LOSS ARISING OUT OF OR IN CONNECTION WITH THE SALE, MAINTENANCE, USE, OR FAILURE OF THE PRODUCT(S). SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO THE PURCHASER. THIS WARRANTY GIVES THE PURCHASER SPECIFIC LEGAL RIGHTS, AND THE PURCHASER MAY HAVE OTHER RIGHTS WHICH MAY VARY FROM STATE TO STATE.
THE COMPANY MAKES NO EXPRESS OR IMPLIED WARRANTIES OTHER THAN AS SPECIFICALLY SET FORTH IN THIS WARRANTY. THE WARRANTY CONTAINED HEREIN IS THE EXCLUSIVE WARRANTY MADE BY THE COMPANY AND THERE ARE NO OTHER WARRANTIES, WHETHER EXPRESS OR IMPLIED BY LAW OR EQUITY, COURSE OF DEALING, COURSE OF PERFORMANCE, USAGE OF TRADE OR OTHERWISE, INCLUDING A WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE; OF MERCHANTABILITY; IMPLIED WARRANTY OF WORKMANSHIP; WARRANTY OF TITLE; WARRANTY AGAINST INFRINGEMENT OF INTELLECTUAL PROPERTY RIGHTS OF A THIRD PARTY MADE WITH RESPECT TO SUCH PRODUCT(S). THE COMPANY IS NOT LIABLE FOR ANY INJURY OR MISHAPS SUSTAINED IN THE USE OF THIS PRODUCT(S). THE USER OF THIS PRODUCT(S) ACKNOWLEDGES ASSUMED RISKS AND WAIVES ANY AND ALL CLAIMS AGAINST THE COMPANY AND ANY OF ITS AGENTS.
